1. What the service is — and is not

ClearSite loads a website you direct us to, gathers observable technical signals, and returns a severity-ranked report and a downloadable artifact. Reports describe OBSERVABLE TECHNICAL FACTS about the specific pages scanned at the time of the scan.

The service is NOT a legal compliance audit, attestation, or certification, and it does not certify compliance with HIPAA, ADA, or any law or regulation. It does not, and cannot, assess items that are not observable from outside the site (for example, signed vendor agreements, server configuration, or internal policies). A "pass" means only that no high-priority technical issues were found at the scan threshold on the pages crawled.

Nothing in a report is legal advice, and using ClearSite does not create an attorney-client or other professional relationship. For your specific legal obligations, consult an attorney licensed in your jurisdiction.

2. Authorization to scan

You may submit a URL for scanning only if you own the site or are otherwise authorized to have it scanned. You represent that you have that authority for every URL you submit. Interactive and behind-login scans are additionally gated on our ownership-verification process.

You may not use the service to scan sites you do not control or are not authorized to test, and you may not use it to probe, overload, or attack any system.

3. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. Provide accurate information and notify us of any unauthorized use.

4. Payment

The full report unlock is a one-time charge shown at checkout (currently $49, including the full-site scan). Monitoring subscriptions, where offered, bill on a recurring basis until cancelled. Payments are processed by Stripe; we do not receive or store your full card details. Prices are in U.S. dollars and exclusive of any applicable taxes.

Refunds are governed by our Refund Policy.

5. Acceptable use

You agree not to: (a) scan sites you are not authorized to scan; (b) resell, relabel, or present a report as a legal compliance certification or as your own audit product; (c) reverse engineer, scrape, or attempt to extract the underlying rule packs, enforcement data, or models; or (d) use the service to build a competing dataset. Report artifacts you purchase are licensed to you for your own and your client's internal use.

6. Intellectual property

The service, its rule packs, enforcement corpus, benchmarks, and software are our intellectual property. We grant you a limited, non-exclusive, non-transferable license to use the service and to use the reports you purchase for the purposes described above. You retain ownership of the URLs and site data you submit.

7. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that a scan detects every issue, tracker, or form on a site, that results are error-free, or that the service will be uninterrupted. Tracker and vendor detection matches a known-vendor catalog, so the absence of a finding is not proof a site is free of trackers.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any regulatory, enforcement, or legal outcome, even if advised of the possibility.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the service in breach of these Terms, including your submission of URLs you were not authorized to scan and your representation of a report as a legal certification.

10. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access for breach of these Terms, including unauthorized scanning.

11. Changes

We may update these Terms; material changes will be reflected by an updated effective date and, where appropriate, notice to you. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of [STATE — SET BEFORE LAUNCH], without regard to conflict-of-laws rules.
